Waste Collection Bloomsbury Service Terms and Conditions

These Terms and Conditions set out the basis on which Waste Collection Bloomsbury provides waste collection and related services to residential, commercial, and institutional customers in Bloomsbury and nearby areas. By placing a booking, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means the individual, company, organisation, or other entity requesting or receiving waste collection services from Waste Collection Bloomsbury.

Company, we, us, our means Waste Collection Bloomsbury as the provider of the waste collection services.

Services means any waste collection, removal, loading, sorting, or related services provided by the Company to the Customer.

Waste means any refuse, rubbish, junk, bulky items, recyclables, or other materials presented by the Customer for collection, excluding prohibited or hazardous waste as defined in these terms or by applicable law.

Agreement means the contract between the Customer and the Company comprising these Terms and Conditions and any written or recorded confirmation of booking.

2. Scope of Services

The Company provides scheduled and one-off waste collection services, including bulky waste removal, commercial waste pickups, and general refuse collection in Bloomsbury and surrounding areas. The exact scope of the Services, including the type and quantity of waste to be collected, collection address, access requirements, date, and time window, will be agreed with the Customer during the booking process.

The Company reserves the right to refuse to collect any waste that is not accurately described at the time of booking or that falls into a prohibited category under applicable waste regulations or these Terms and Conditions.

3. Booking Process

3.1 Bookings can be made by telephone or other communication channels made available by the Company. Bookings are subject to availability and are not confirmed until the Customer receives a confirmation from the Company.

3.2 At the time of booking, the Customer must provide accurate details, including but not limited to:

a. Full name or company name

b. Collection address and any access instructions

c. Contact telephone number and email address

d. Description, volume, and approximate weight of the waste

e. Any special handling requirements or restrictions

3.3 The price quoted for the Services will be based on the information provided by the Customer. If, upon arrival, the waste materially exceeds the description or requires additional time, labour, or disposal costs, the Company may revise the price. In such cases, the Customer will be informed before the work proceeds.

3.4 The Customer is responsible for ensuring that the person making the booking has the authority to enter into an Agreement on behalf of the Customer.

4. Access and Collection Conditions

4.1 The Customer must ensure that the Company has safe and reasonable access to the waste at the agreed collection time. This includes arranging parking or loading space where necessary and complying with local parking and access regulations.

4.2 If the Company is unable to access the waste due to incorrect address details, access restrictions, the Customer not being present where necessary, or any other issue beyond the Companys reasonable control, the Company may charge a wasted journey fee or apply its standard cancellation charges.

4.3 The waste must be presented in a manner that is safe for the Companys staff to handle. The Company may refuse to collect waste that is considered unsafe, contaminated, or improperly contained.

5. Waste Types and Regulations

5.1 The Customer agrees that all waste presented for collection complies with applicable UK waste management laws, regulations, and codes of practice, including those relating to controlled, hazardous, and special waste.

5.2 The Company does not normally collect hazardous or prohibited materials, which may include, but are not limited to:

a. Asbestos or asbestos-containing materials

b. Clinical or medical waste, sharps, or biological material

c. Chemicals, solvents, paints, oils, and fuels except as agreed in writing

d. Gas cylinders, pressurised containers, or explosive materials

e. Radioactive materials

f. Corrosive, toxic, or highly flammable substances

5.3 If the Customer presents hazardous or prohibited waste without prior written agreement, the Company may refuse collection, charge additional fees for handling, or require the Customer to remove such items. The Customer will be responsible for any costs, losses, or damages incurred by the Company as a result of incorrect or incomplete information regarding the nature of the waste.

5.4 Where applicable, the Company will arrange disposal or recovery at appropriately licensed facilities and will take reasonable steps to prioritise recycling and responsible waste management in line with current environmental standards.

6. Duty of Care and Waste Transfer

6.1 The Company will operate in accordance with its legal duty of care under waste legislation. Where required, a waste transfer note or similar documentation will be completed. The Customer must provide accurate information for this documentation.

6.2 Title to the waste will pass to the Company at the point of loading, provided that the waste complies with the description given by the Customer and does not include prohibited materials. The Company reserves the right to return waste to the Customer or to seek recovery of costs if misdescribed or hazardous waste is discovered after collection.

7. Prices and Payment

7.1 Prices for the Services are stated in pounds sterling and are exclusive of any applicable taxes, which will be added where required by law.

7.2 Unless otherwise agreed, payment is due at the time of booking or upon completion of the collection, and may be made by accepted payment methods such as debit or credit card, bank transfer, or other methods notified by the Company.

7.3 For business Customers, the Company may agree credit terms in writing. In such cases, invoices are payable in full within the period stated on the invoice. If no period is stated, payment will be due within 14 days of the invoice date.

7.4 The Company reserves the right to charge interest on overdue amounts at the statutory rate applicable in the United Kingdom, accruing daily until payment is received in full, together with any reasonable recovery costs.

7.5 The Company may withhold or suspend services if payments are overdue or if there is reasonable doubt as to the Customers ability or willingness to pay for the services.

8. Cancellations and Amendments

8.1 The Customer may cancel or amend a booking by contacting the Company during normal business hours.

8.2 If the Customer cancels more than 24 hours before the scheduled collection time, no cancellation fee will normally apply, unless otherwise stated at the time of booking.

8.3 If the Customer cancels within 24 hours of the scheduled collection time, the Company reserves the right to charge a cancellation fee up to a reasonable proportion of the quoted price, to reflect the costs and resources allocated.

8.4 If the Company arrives at the collection address at the agreed time and is unable to complete the service due to the Customers act or omission, this may be treated as a late cancellation or wasted journey. The Company may charge a call-out fee or the full service fee in such circumstances.

8.5 The Company will use reasonable efforts to accommodate requests to change the collection time or date, but such changes are subject to availability and may result in revised pricing.

9. Service Performance and Delays

9.1 The Company will use reasonable care and skill in providing the Services and will make reasonable efforts to meet agreed collection times. However, any times given for collection are estimates only and may be affected by traffic, weather, access problems, or other circumstances beyond the Companys control.

9.2 The Company shall not be liable for any delay or failure to perform the Services where such delay or failure is due to an event beyond its reasonable control, including but not limited to traffic congestion, road closures, severe weather, accidents, strikes, or the actions of third parties.

9.3 If a significant delay or inability to perform the service becomes apparent, the Company will contact the Customer as soon as reasonably practicable to arrange an alternative time or date.

10. Customer Responsibilities

10.1 The Customer is responsible for:

a. Providing accurate information at the time of booking

b. Ensuring safe and reasonable access to the waste

c. Ensuring that the waste presented for collection matches the description provided and does not include prohibited materials

d. Complying with all applicable laws, regulations, and local requirements relating to waste storage and presentation

10.2 The Customer shall indemnify the Company against all claims, losses, damages, costs, and expenses arising from any breach of these responsibilities, including any fines or penalties arising from misdescribed or unlawfully presented waste.

11. Liability and Limitations

11.1 Nothing in these Terms and Conditions shall limit or exclude the Companys liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.

11.2 Subject to clause 11.1, the Companys total liability to the Customer in respect of all losses arising under or in connection with the Agreement shall in no circumstances exceed the total fees paid or payable for the specific services giving rise to the claim.

11.3 The Company shall not be liable for:

a. Loss of profits, business, revenue, or goodwill

b. Indirect or consequential loss or damage

c. Loss resulting from delays or cancellations caused by events beyond its reasonable control

11.4 While reasonable care will be taken when carrying out the Services, the Customer is responsible for protecting driveways, surfaces, gates, walls, and other property. The Company shall not be liable for cosmetic damage to surfaces, minor scuffs, or wear consistent with normal loading and unloading activities, provided reasonable care has been exercised.

12. Complaints

12.1 If the Customer is dissatisfied with any aspect of the service, they should contact the Company as soon as possible, providing full details of the issue.

12.2 The Company will investigate complaints in a fair and timely manner and will aim to provide a response or resolution within a reasonable period. Any remedies offered will be at the Companys discretion, subject to applicable law and these Terms and Conditions.

13. Data Protection and Privacy

13.1 The Company will handle any personal information provided by the Customer in accordance with applicable UK data protection laws.

13.2 Personal data will be used only for legitimate business purposes, such as administering bookings, providing the Services, processing payments, and handling enquiries or complaints.

14. Variation of Terms

14.1 The Company reserves the right to update or amend these Terms and Conditions from time to time. Any changes will take effect when published or otherwise notified to the Customer and will apply to future bookings.

14.2 The terms in force at the time of the Customers booking will apply to that booking, unless changes are required by law or regulation.

15. Severability

15.1 If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful, or unenforceable, such provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

16.1 These Terms and Conditions, together with any written or recorded booking confirmation, constitute the entire agreement between the Customer and the Company regarding the provision of the Services and supersede any prior agreements, understandings, or arrangements.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation.

By confirming a booking with Waste Collection Bloomsbury, the Customer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
